Multi Light Sample doesn't start because of incorring assumptions about render device

Description

Happened to me in both OpenGL and DirectX9.
Starting the sample, you get the following message: "This sample uses dynamic loops in cg type shader language, your graphics card must support shader 3 profile or above. You cannot run this sample."

I do have the latest drivers and the 580 GTX definitely has shader profile 3 or above

Environment

Windows 7 64-bit, GeForce 580 GTX, Compiled with MinGW GCC 4.7.1
